Within what time the trial under the Protection of Children from Sexual Offences (POCSO) Act should ideally be completed ?
Answer: C
The trial should be completed within 1 year from the date of taking cognizance.
Section 35(2) of the POCSO Act requires the Special Court to complete the trial, as far as possible, within a period of one year from the date of taking cognizance of the offence. Section 35(1) separately requires the child's evidence to be recorded within thirty days of cognizance.
The Act does not count from the FIR or the charge sheet, and it does set a time limit.
