Discussion
“Confession caused by inducement, threat or promise when irrelevant in criminal proceeding.” Which section of Indian Evidence Act, 1872, is being discussed here?
Answer: C
A confession caused by inducement, threat or promise, when it is irrelevant in a criminal proceeding, is dealt with in Section 24 of the Indian Evidence Act, 1872: such a confession is irrelevant if the court is of opinion that the inducement, threat or promise gives the accused reasonable grounds to suppose that he would gain an advantage or avoid an evil in the proceedings.
Section 27 deals with how much of the information received from an accused may be proved, Section 28 with a confession made after the removal of the impression caused by inducement, threat or promise, and Section 44 with fraud or collusion in obtaining a judgment. None of these has the heading of the passage.
