Choose the true statements about the Preamble of the Constitution:
1) The Preamble to the Indian Constitution is based on the 'Objectives Resolution' drafted by Pandit J.L.Nehru
2) 42nd Constitutional Amendment Act of 1976, added three new words namely Sovereign, Socialist and Secular to the Preamble.
3) In Berubari Union case (1960), Supreme Court held that Preamble is part of Indian Constitution.
4) Preamble can be amended under Art. 368 of the Constitution subject to the condition that no amendment is done to the 'basic features'.
Answer: A
Statements 1 and 4 are true, so the answer is 1 and 4 only.
The Preamble is based on the Objectives Resolution moved by Jawaharlal Nehru in the Constituent Assembly in December 1946 (1). In Kesavananda Bharati (1973) the Supreme Court held that the Preamble can be amended under Article 368, provided the basic features are not altered (4).
Statement 2 is false: the 42nd Amendment (1976) added Socialist, Secular and Integrity; 'Sovereign' was there from the start. Statement 3 is false: in the Berubari Union case (1960) the Court held that the Preamble is not part of the Constitution, a view reversed in Kesavananda Bharati. Options with 2 or 3 are therefore wrong.
