The soul of democratic legality is its social dimension best expressed in the words
ofJulius Stone as Human Law and Human Justicc-'fhe exprcssion of the goals of legal
justice adopted by a community, based on its historical, social, economic and cultural
conditions, and the strategies rvhereby its value judgemcnts are accomplished, constitute
its jural postulates and processcs. Law is a normative and regulatory system and
mechanism as a means towards social justice. I-aw ways must lead to orderly progress
of the nation if functional justification and social validation must be found for their
observance. In sum, Law lndia fulfils itsctfonly when the spirit of change and the spirit
of consewation march in step. Aware Lawmen are architects, engineers, statesmen and
synthesists, not prisoners of stare decisis, not robed men who go-it-alone, not trained
machinists in litigative techniques or text book teaching. They are the avant garde
giving pragnatic shape to 'the felt necessities of the time, the prevalent moral and
political theories and institutions ofpublic policy.' They draft, interpret and implement
statutes in such manner that rapid evolution keeping pace with the mores of the
community is organizcd through socially purposeful normative prescriptions Lawyers
and legislators will do wcll to realize that our cthos is a precious testament of the past
but our nation will break to pieces if we do not break with the unjust part of the past.
Mere change without conservation may lose our identifiable entity and end up as a
disastrous carbon copy of foreign systems. Merc conservation without change cannot
conserye, sincc the flux of the world around and massive hunger for the good life
compel radical readjustment as the pnce of peaceful continuance. My thesis is that if
Lavris to living, creative innovations and dynamic synthesis are essential to the rule of
law and constitutional order. This is not jural rhetoric nor legal romantics but simple
realism and communal sensitivity. The call to lawyers-an expression which must
include law-makers and implementers, not merely the Bench and the Bar-must
necessarily be to modernize legal technology fertilized by ongoing social interaction, to
work out triginal legal models and to producc viable principles which will clothe with
flesh and blood, Arlicle 38 ofthe Constitution which reads :

3 Write a pr6cis in English of the following passage : 40
The ideal of the Indian race is freedom of the soul. This world is nothing. It is a
vision, a dream. This life is one of many millions like it. The whole of this nature is
Maya, is phantasm, a pest house of phantasms. That is the philosophy. Babies smile at
life and think it so beautiful and good, but in a few years they will have to revert to
where they began. They began life crfing, and they will leave it crfng. Nations in the
vigour of their youth think that they can do anyhing and everyhing : "We are the Gods
of the earth. We are the chosen people." They think that God Almighry has given them
a charter to rule over all the world, to advance His plans, to do anything they like, to
tum the world upside down. They have a charter to rob, murder, kill; God has given
them this, and they do that because they are only babes. So empire after empire has
arisen-glorious, resplendent-now vanished away-gonc, nobody knows where; it may
have been stupcndous in its ruin.
As a drop of water upon a lotus leaf tumbles about and falls in a moment, even so
is this mortal life. Everywhere we tum are ruins. Wherc lhe lorest stands today was
once the mighty empirc with huge cities. That is dominant idea, the tone, the colour of
the Indian minrl. We know, you Westem peoplc havc the youthful blood coursing
through your vcins. Wc know that nations, like mcn, have their day. Where is Greece ?
Where is Rome ? Whcre that mighty Spaniard of the othcr day ? Who knows through it
all what becomes of India ? Thus they are born, and thus they die; they rise and fall. The
Hindu as a child knows of the Mogul invader whose cohorts no power on earth could
stop, who has left in your language the terrible word "'[anar". The Hindu has leamt his
lesson. He does not want to prattle, like the babes of today. Western people, say what
you have to say. This is your day. Onward, go on, babes; have your prattle out. This is
the day of the babies, to prattle. We have leamt our lesson and are quiet. You have a
little wealth today, and you look down upon us. Well, this is your day. Prattle, babes,
prattle-this is the Hindu's attitude.
