What is not true about the Constituent Assembly ?

A.It was based on the recommendations of Cabinet Mission.
B.It was constituted by indirect elections.
C.At least one seat was given to each Indiasn State.
D.Seats in each Province were distributed among the three main communities in proportion to their population.

Exam Year(s)

UGC NET - 2012,

Answer: C

The statement that is not true is that at least one seat was given to each Indian State. Under the Cabinet Mission plan the seats were allotted in proportion to population, at about one for each million, and the princely states were allotted a total of 93 seats as a group, so a small state did not automatically get a seat. The Assembly was based on the Cabinet Mission recommendations, was elected indirectly by the provincial legislatures, and seats of the provinces were divided among the three main communities according to their population.

A.Inter-State Council
B.Finance Commission
C.Union Public Service Commission
D.National Development Council

The National Development Council is not a constitutional body: it was set up by a resolution of the government in 1952 and is neither constitutional nor statutory. The Inter-State Council is provided for in Article 263, the Finance Commission in Article 280, and the Union Public Service Commission in Article 315 of the Constitution, so these three are constitutional bodies. So the answer is the National Development Council.

The President may remove the Chairman or member of the Public Service Commission without making a reference to the Supreme Court. Which is not true in this context ?

A.The Chairman or Member is adjudged as insolvent.
B.The Chairman or Member engages in some paid employment outside while in office.
C.The Chairman or Member is guilty of misbehaviour.
D.The Chairman or Member is unfit to continue in Office due to infirmity of mind or body.

Exam Year(s)

UGC NET - 2012,

Answer: C

Under Article 317 the President may remove the Chairman or a member of a Public Service Commission without a reference to the Supreme Court if the person is adjudged insolvent, engages in paid employment outside the duties of the office, or is unfit by reason of infirmity of mind or body. Removal for misbehaviour can be made only after the Supreme Court has held an inquiry and reported that the person should be removed, so statement C is not true in this context. The grounds that need no reference are the three listed in the proviso to Article 317(2), and misbehaviour is not one of them.

Civil Services preliminary examination (objective type) for the selection of candidates for the Civil Services (Main) was recommended by

A.Hota Committee
B.Kothari Committee
C.Satish Chandra Committee
D.Gopalaswamy Ayyangar Committee

Exam Year(s)

UGC NET - 2012,

Answer: B

The Kothari Committee on the Recruitment Policy and Selection Methods (1974-76) recommended a three-stage civil services examination: a preliminary examination of the objective type, a main examination and a personality test. The Hota Committee, the Satish Chandra Committee and the Gopalaswamy Ayyangar Committee reported on other aspects of recruitment or administration, so Kothari is the answer. The commission recommended a pre-selection test of the objective type to screen the very large number of candidates before the main examination, a scheme that was adopted from 1979.

Assertion (A) : To provide avenues of public employment to suitable educated Indians, a separate civil service called the statutory civil service was created in 1879.

Reason (R) : All India Services maintain the integrity of the Nation.

A.Both (A) and (R) are correct and (R) is the correct explanation of (A).
B.Both (A) and (R) are correct, but (R) is not the correct explanation of (A).
C.(A) is true, but (R) is false.
D.(A) is false, but (R) is true.

Exam Year(s)

UGC NET - 2012,

Answer: B

Both statements are true, but the reason does not explain the assertion. The statutory civil service was created in 1879 under Lord Lytton to give suitable educated Indians an avenue of public employment, and the All India Services do help to maintain the integrity of the nation. These are separate facts: the integrity of the nation through All India Services has no bearing on why the statutory civil service was set up, so option B is correct.

Assertion (A) : The UPSC is the designated recruitment agency for the All India Services.

Reason (R) : The All India Services provide a valuable link between the Union and the State Governments.

A.Both (A) and (R) are true and (R) is the correct explanation of (A).
B.Both (A) and (R) are true, but (R) is not the correct explanation of (A).
C.(A) is true, but (R) is false.
D.(A) is false, but (R) is true.

Exam Year(s)

UGC NET - 2012,

Answer: B

Both statements are true, but the reason does not explain the assertion. The Union Public Service Commission is the agency designated to recruit the All India Services, and the All India Services provide a valuable link between the Union and the State governments. The link function is a feature of these services, not the reason why the UPSC recruits them, so (R) is not the correct explanation. Option B is the answer.

Assertion (A) : Judicial Activism is an effective mean of judicial control over Public Administration.

Reason (R) : The PILs have enhanced the judicial control over public administration.

Answer: A

Both statements are true and the reason explains the assertion. Judicial activism is an effective means of judicial control over public administration, and public interest litigations have enhanced that control, because they let courts take up administrative failures on behalf of those who could not approach them. Since the PILs are the way judicial activism has worked in practice, the reason explains the assertion and option A is correct.
